Welcome to Five Rise!

Five Rise is a web application owned and operated by FiveRiseTechnology Limited, a company incorporated in Ireland ("Five Rise," "we," "our," or "us"). By accessing or using Five Rise (the "app"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using Five Rise, you agree to:

We may update these Terms occasionally. Your continued use of the app means you accept any changes.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Five Rise.

3. Account Registration

• Provide accurate and up-to-date information.
• Keep your login details private and secure.
• Notify us immediately of unauthorized access.

4. Using the Service

5. Subscription and Payment

• Some features are paid ("Premium Service").
• Fees, billing cycles, and cancellation policies are displayed clearly before purchase.
• You are responsible for timely payment.
• We may update fees for future billing cycles with notice.

6. Cancellation Policy

You can cancel your Five Rise subscription at any time from your account settings. When you cancel:

• Your access will continue until the end of your current billing period.
• You won't be charged again unless you restart your subscription.
• Charges for the current billing period are not refundable, except where covered by our refund policy.
• If you're within your 14-day free trial, cancelling stops all future charges immediately.

7. Refund Policy

Five Rise offers a 14-day free trial for all new users. You won't be charged until your trial ends, and no payment is taken if you cancel before it finishes.

If you're charged after the trial and the product isn't right for you, you may request a full refund within 14 days of your first payment.

Renewal payments are normally non-refundable, but we will refund any accidental renewal reported within 48 hours of the charge.

Billing mistakes—such as duplicate charges or technical errors—are always refunded in full.

To request a refund, contact support@fiverisetech.com with your account email and the charge details.

8. User Content & Insights

Your Content:

You own what you add — goals, tasks, notes, and other personal entries.

How We Use Your Content:

• We do not sell or share your personal data with third parties without your explicit consent.
• Your data may be analyzed by the Service, including trusted AI tools, to provide you with insights, trends, and recommendations designed to help improve your productivity.
• Aggregated or anonymized data may be used for research, analytics and to improve the app overall, but no personally identifiable data will be shared externally.

Automated Insights:

• The app may generate automated suggestions based on your activity.
• These insights are for your benefit and are not shared externally without your permission.
• AI-generated suggestions may be provided for your benefit only and do not make legally binding decisions.
• You acknowledge that your data may be processed by trusted AI providers under strict security and privacy agreements to deliver these insights.

Privacy & Security:

• Your data is private and protected.
• You can request deletion anytime.

Your Responsibility:

• Do not upload illegal, harmful, or inappropriate content.
• We may remove content violating these Terms.

Ethical Data Use:

We commit to using your data responsibly to generate productivity insights and improve the Service. Insights are used internally and shared only in anonymized or aggregated form unless you grant permission.

9. Intellectual Property

All non-user content belongs to Five Rise or its licensors. You may not copy, modify, sell, or create derivatives without written permission.

10. Privacy

Your use is also governed by our Privacy Policy. By using the app, you consent to our data practices.

11. Termination

• We may suspend or terminate accounts that violate these Terms.
• You may cancel your account at any time.
• Termination does not remove obligations for payments already due.
• Your content may be removed upon termination.

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, or technical failures.

13. Disclaimer of Warranties

The Service is provided "as-is" and "as available." We do not guarantee uninterrupted or error-free operation.

14. Limitation of Liability

We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data.

15. Indemnification

You agree to protect and hold harmless Five Rise and its affiliates from any claims or losses arising from your use of the Service.

16. Governing Law

These Terms are governed by the laws of Ireland, and disputes will be resolved exclusively in Irish courts.

17. Severability

If a provision is found invalid or unenforceable, the rest of the Terms remain in effect.

18. Entire Agreement

These Terms, along with our Privacy Policy, form the complete agreement between you and Five Rise.
